March 2021 Discipline

These lawyers were the subject of Louisiana Supreme Court disciplinary orders or Louisiana Attorney Disciplinary Board recommendations published during the month of March 2021.

Louisiana Supreme Court

  1. Jack H. Tobias. The court transferred the respondent to disability inactive status.
  2. Stacy Michele Young. The court disbarred the respondent. The respondent stipulated that she converted $10,267.47 in funds belonging to her former law firm and/or its clients. In so doing, the respondent violated rules 8.4(a), 8.4(b), and 8.4(c) .
  3. Hilliard Charles Fazande, III. The court permanently disbarred the respondent. The respondent neglected a legal matter, failed to communicate with a client, failed to refund an unearned fee, practiced law while ineligible to do so, and failed to cooperate with the ODC in its investigation. In so doing, the respondent violated rules 1.1, 1.3, 1.4, 1.5, 1.16 (a)(1)(c)(d), 5.5(a), 8.1(c), and 8.4(c).
  4. Kemic Alan Smothers. The court suspended the respondent for one year and one day. The respondent practiced law while ineligible to do so. In so doing, the respondent violated rules 1.1(b)(c), 5.5(a), 5.5(e)(3), and 8.4(a).
  5. Stephen A. Jefferson. The court granted the respondent’s petition to resign from the practice of law in lieu of discipline.
  6. Craig T. Broussard. The court granted the respondent’s petition to resign from the practice of law in lieu of discipline.
  7. Paul J. Barker. The court granted a Joint Petition to Transfer to Active Status filed by the respondent and the Office of Disciplinary Counsel.
  8. Mark G. Simmons. The court suspended the respondent for three years, retroactive to October 16, 2017, the date of his suspension in In re: Simmons, 17-1043. The respondent practiced law during a period of suspension. In so doing, the respondent violated rules 5.5(a) and 8.4(a).
  9. Clarence T. Nalls, Jr. The court ordered that the respondent shall not petition for readmission until five years have passed from the finality of this judgment. The respondent engaged in the unauthorized practice of law and dishonest conduct. In so doing, the respondent violated rules 5.5(a), 8.4(a), and 8.4(c) 

Louisiana Attorney Disciplinary Board

  1. Kimuel W. Lee. The board recommended that the court deny the respondent’s application for reinstatement. The respondent failed to meet the requirements for reinstatement.

LADB Hearing Committees

  1. Sheila J. Linscomb. Hearing Committee #25 recommended that the court deny the respondent’s petition for reinstatement. The respondent failed to make restitution.
  2. Jerome M. Volk, Jr. Hearing Committee #25 recommended that the court suspend the respondent for three years. The respondent delayed payment of settlement money, held on to client funds, and failed to respond to the ODC on more than one occasion. In so doing, the respondent violated rules 1.3, 1.4, 1.15(a), 1.15(d), 8.1(b), 8.1(c), 8.4(a), 8.4(c).
