New Arizona Law Requires That State Bar Pay Legal Fees If Bar Seeks to Discipline Lawyer But Ends Up Loosing

On May 9, 2022, Arizona Governor Doug Ducey signed a bill requiring the Arizona State Bar to pay lawyer fees and other costs of lawyers who prevail in their lawyer discipline cases. See Ariz. Rev. Stat. § 12-341.01.

Under the new law, the Arizona state bar must pay for legal fees and court costs if it seeks to discipline a lawyer but loses. The fee and cost requirement does not apply to cases dismissed by the bar before final disposition. The bill originally required the state bar to pay for the costs of the investigation, the loss of future earnings and damage to a lawyer’s reputation, but lawmakers eventually removed those portions of the bill.
